Article 1: General provisions
The e-commerce website of RÊVEUR, a sole proprietorship with registered office at Voorzienigheidsstraat 74, 8500 Kortrijk, BTW BE 0721 908 444, RPR Gent, (hereinafter "RÊVEUR") offers its customers the opportunity to purchase the products from its online store.
These terms and conditions ("Terms") apply to any order placed by a visitor to this e-commerce site ("Customer"). When placing an order via the RÊVEUR online store, the customer must expressly accept these Conditions, thus accepting the applicability of these conditions, to the exclusion of all other conditions. Additional conditions of the customer are excluded, unless they have been expressly accepted in advance by RÊVEUR in writing.
Article 2: Price
All prices shown are expressed in EURO, always including VAT and any other duties or taxes required by the customer.
If delivery, reservation or administrative costs are charged, this will be indicated separately.
The price statement refers exclusively to the items as described verbatim. The accompanying photos are decorative and may contain items that are not included in the price.
Article 3: Offer
Although the online catalog and the e-commerce site have been compiled with the greatest care, it is always possible that the information provided is incomplete, contains material errors or is not up to date. Obvious faults or errors in the offer do not bind RÊVEUR. RÊVEUR is only bound by an obligation of means as to the accuracy and completeness of the information provided. RÊVEUR is in no way responsible in the event of obvious material errors, composition or printing errors.
If the customer has specific questions regarding, for example, sizes, color, availability, delivery time or delivery method, we ask the customer to contact our customer service in advance.
The offer is valid while stocks last and may be adjusted or withdrawn by RÊVEUR at any time. RÊVEUR cannot be held responsible for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be expressly stated in the offer.
Article 4: Online purchases
After adding the desired product to your basket, the Customer enters the personal data and proceeds to payment.
The Customer has the choice between the following payment methods
- by credit card
- by Bancontact
RÊVEUR is entitled to refuse an order due to a serious breach by the Customer with regard to the orders in which the Customer is involved.
Article 5: Delivery and execution of the contract
Items ordered via this online store are delivered to Belgium, the Netherlands and France.
Delivery is made by Post NL. The delivery time of this postal service is 3 to 5 working days.
Standard parcel delivery:
- Belgium: €5.95
- France: €15.95
- The Netherlands: (from) €9.95
Local delivery:
+/- 5.5 km Oudenaarde or Kortrijk: €3.95
Unless otherwise agreed or expressly provided otherwise, the goods will be delivered to the Customer's domicile within 15 days of receipt of the order.
Any apparent damage and/or qualitative defect of an item or other delivery defect must be reported by the Customer to RÊVEUR without delay.
The risk of loss or damage is transferred to the Customer as soon as he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk is already transferred to the Customer upon delivery to the carrier, if the carrier has been mandated by the Customer to transport the goods and this choice has not been proposed by RÊVEUR.
Article 6: Retention of title
The items delivered remain the exclusive property of RÊVEUR until full payment of the price by the Customer.
If applicable, the Customer undertakes to inform third parties of RÊVEUR's retention of title, for example any person who seizes items not yet fully paid for.
Article 7: Right of withdrawal
The provisions of this article apply only to Customers who purchase items online from RÊVEUR in their capacity as consumers.
The customer has the right to withdraw from the contract within 14 calendar days without giving reasons.
The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, materially takes possession of the first good.
To exercise the right of withdrawal, the Customer must inform RÊVEUR, Providence Street 74, 8500 Kortrijk, sales@reveurwrld.com by means of an unambiguous declaration (for example in writing by e-mail) of his decision to terminate the contract. .
In order to respect the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the expiry of the withdrawal period.
The Customer must immediately return or hand over the goods to RÊVEUR, Providence Street 74, 8500 Kortrijk, but in any event no later than 14 calendar days after the day on which he notified RÊVEUR of his decision to terminate the contract. The Customer is punctual if he returns the goods before the expiry of the period of 14 calendar days.
The direct costs of returning the goods will be borne by the Customer. The costs are estimated at a maximum of approximately 5.60 EUR.
If the returned product suffers any depreciation, RÊVEUR reserves the right to hold the Customer liable and to claim compensation for any loss in value of the goods resulting from the use of the goods by the Customer going beyond what is necessary to establish the nature, characteristics and operation of the property.
Only items that are in the original packaging, together with all accessories, instructions for use and the invoice or proof of purchase can be returned.
Article 8: Guarantee
Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.
To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the Customer's home, the Customer must contact RÊVEUR's customer service and return the item to RÊVEUR at his own expense.
If a defect is found, the Customer must inform RÊVEUR as soon as possible. In any event, any defect must be reported by the Customer within 2 months of its discovery. Thereafter, any right to repair or replacement lapses.
The warranty (commercial and/or legal) never applies to defects that occur as a result of accidents, negligence, falls, use of the article contrary to the use for which it was designed , non-compliance with the instructions for use or manual, adjustments or modifications to the article, intensive use, poor maintenance or any other abnormal or incorrect use.
Defects which appear after a period of 6 months following the date of purchase, if applicable of delivery, are deemed not to be latent defects, unless proven otherwise by the Customer.
Article 9: Customer service
RÊVEUR customer service can be reached by email at contact@reveurwrld.com. Any complaint can be addressed to him.
Article 10: Penalties for non-payment
Without prejudice to the exercise of other rights available to RÊVEUR, in the event of non-payment or late payment from the date of default, the Customer shall be liable automatically and without formal notice for an interest of 10 % per year on the unpaid amount. In addition, ipso jure and without formal notice, the Customer is liable for a fixed indemnity of 10% of the amount concerned, with a minimum of 25 euros per invoice.
Without prejudice to the foregoing, RÊVEUR reserves the right to take back unpaid items (in full).
Article 11: Infringement of validity - non-waiver
If any provision of these Terms is held to be invalid, illegal or void, this will not affect the validity, legality and enforceability of the remaining provisions. Failure at any time by DREAMER to enforce any of the rights listed in these Terms, or to exercise any of the rights herein, shall never be deemed a waiver of such provision and shall never affect the validity of these rights.
Article 12: Modification of the conditions
These Conditions are supplemented by other conditions expressly referred to and the general conditions of sale of RÊVEUR. In case of contradiction, these general conditions will prevail.
Article 13: Proof
The Customer accepts that electronic communications and backups may serve as proof.
Article 14: Applicable law – Disputes
Belgian law applies, with the exception of the provisions of private international law concerning the applicable law.
The courts of the Consumer's place of residence have jurisdiction in the event of a dispute. The Consumer can also contact the ODR platform (http://ec.europa.eu/consumers/odr/).
